Associations and Foundations

Law Firm Burlacu > Associations and Foundations

The establishment of associations and foundations is regulated by O.G. no. 26 of 2000, whose provisions do not apply to political parties, trade unions and religious denominations. Thus, natural persons and legal entities, which pursue the development of activities of general interest or in the interest of certain communities or, in their personal non-patrimonial interest, may constitute associations and foundations, which are legal persons of private law without patrimonial purpose.

Burlacu Law Firm provides legal advice, assistance and representation on the registration of non-profit organizations in Romania (NGOs) as well as for any change in the status of such an organization. We provide legal advice on changes of associations and foundations, establishment of association, establishment of foundation, establishment of owners association

Upon request, we provide permanent legal advice on the activity of the organization.

Documents required for setting up an association/foundation:

  • Copy of CI / Passport of founding members
  • Copy of the space contract for the association’s headquarters
  • Identification data of the (co) owners of the headquarters
  • A variant for the name of the association/foundation
  • Proof of deposit of assets
  • The term for setting up an association is 45 days – at which time the association will be fully operational

Obtaining the court decision regarding the order of registration in the Register of Associations and Foundations is done in 21 days, but, due to the procedures that must be fulfilled for this decision to remain final, the term reaches 45 days.
